Acceptance of Terms

By accessing or using Spoot (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms apply to all users of the Service, including professionals who create accounts and end-clients who book appointments.

Service Description

Spoot is a scheduling and appointment management platform designed for beauty and wellness professionals. The Service includes: an online dashboard for managing appointments, clients, services, and finances; public booking pages for end-clients; AI-powered WhatsApp messaging for automated booking assistance; appointment reminders and notifications; and payment processing for subscriptions.

Eligibility

You must be at least 18 years old and have the legal capacity to enter into a binding agreement to use the Service. By creating an account, you represent and warrant that you meet these requirements.

Account Registration & Security

You must provide accurate, complete, and current information when creating an account. You are responsible for maintaining the security of your account and for all activities that occur under it. You must notify us immediately of any unauthorized access. Spoot uses passwordless authentication via email magic links. You may not share your login links with others or use another person's account.

Subscription & Billing

Plans

Spoot offers multiple subscription plans (Basic, Starter, Professional) with different features and pricing. Plan details and current pricing are available on our website. We reserve the right to modify pricing with 30 days' advance notice.

Free Trial

New accounts may receive a free trial period. During the trial, you have access to the features of your selected plan. At the end of the trial, your subscription will not automatically convert to a paid plan — you must actively subscribe to continue using premium features.

Payment

Payments are processed securely through Stripe. By subscribing to a paid plan, you authorize us to charge your payment method on a recurring basis (monthly or annual, depending on your selection). You are responsible for keeping your payment information up to date.

Cancellation

You may cancel your subscription at any time through the Settings page. Upon cancellation, you will retain access to your paid plan features until the end of the current billing period. After that, your account will revert to limited functionality.

Refunds

Subscription fees are generally non-refundable. If you believe you were charged in error, please contact us at support@spoot.it within 14 days of the charge.

Professional Responsibilities

As a professional using Spoot, you are responsible for: maintaining accurate availability and service information; honoring confirmed appointments with your clients; complying with all applicable laws and regulations related to your profession; handling client personal data in accordance with applicable privacy laws; ensuring that your use of WhatsApp messaging complies with Meta's policies and applicable anti-spam regulations.

End-Client Terms

End-clients who book appointments through Spoot are subject to the booking, cancellation, and no-show policies set by each individual professional. Spoot acts as a technology platform and is not a party to the service agreement between the professional and the end-client. Disputes regarding services rendered should be resolved directly between the professional and the end-client.

Acceptable Use

You agree not to: use the Service for any unlawful purpose; send spam, unsolicited messages, or bulk communications through WhatsApp or any other channel; attempt to gain unauthorized access to the Service or its systems; upload malicious code, viruses, or harmful content; impersonate another person or entity; use the Service to collect personal data without proper consent; resell, sublicense, or redistribute the Service without our written permission.

WhatsApp Integration

The WhatsApp integration is provided through the Meta WhatsApp Business API and is subject to Meta's terms and policies. Spoot processes WhatsApp messages to provide AI-assisted booking functionality. You acknowledge that: messages are processed by AI to understand booking intent; conversation context is stored temporarily for continuity; you must comply with WhatsApp's commerce and messaging policies; Meta may impose messaging limits or restrictions independent of Spoot.

Intellectual Property

The Service, including its design, code, branding, and content, is owned by Spoot and protected by intellectual property laws. You retain ownership of all data you input into the Service (client information, appointment data, business details). You grant Spoot a limited license to process this data solely to provide the Service. You may not copy, modify, reverse-engineer, or create derivative works based on the Service.

Limitation of Liability

Spoot is provided "as is" and "as available" without warranties of any kind. To the maximum extent permitted by law, Spoot shall not be liable for: any indirect, incidental, consequential, or punitive damages; loss of revenue, clients, or business opportunities; missed, cancelled, or incorrectly scheduled appointments; actions or omissions of professionals or end-clients; interruptions, errors, or downtime of the Service. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

Indemnification

You agree to indemnify and hold Spoot harmless from any claims, damages, losses, or expenses arising from: your use of the Service; your violation of these Terms; your violation of any third-party rights; any dispute between you and your clients.

Termination

We may suspend or terminate your account at any time if you violate these Terms or engage in conduct that we determine is harmful to other users, the Service, or third parties. Upon termination, your right to use the Service ceases immediately. You may request export of your data within 30 days of termination by contacting us at support@spoot.it.

Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a prominent notice on our website at least 15 days before they take effect. Your continued use of the Service after the changes take effect constitutes acceptance of the updated Terms.

Governing Law & Dispute Resolution

These Terms are governed by the laws of Brazil. For users in the European Economic Area, mandatory consumer protection provisions of your local law shall apply. Any disputes arising from these Terms shall be resolved in the courts of Florianópolis, Santa Catarina, Brazil.
